Terms of Service
These Terms govern your use of Isegora. By creating an account or using the service you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use Isegora.
These Terms are intended to meet transparency expectations for hosting user content under the EU Digital Services Act (DSA) and the UK Online Safety Act, alongside ordinary consumer contract rules in the US, UK, and EU/EEA.
1. Eligibility
You must be at least 13 years old (COPPA and equivalent child-protection rules) and able to form a binding contract where you live. If you use Isegora on behalf of an organization, you represent that you have authority to bind it.
2. Account and consent
- Keep your credentials secure; you are responsible for activity under your account.
- Provide accurate profile information (including date of birth and phone for verification).
- When you register, the in-app checkbox is a short acknowledgement that you agree to these Terms and have read the Privacy Policy. Service processing (account, polls, votes, geo/demographic results, safety, and retention) is described in the Privacy Policy under contract / legitimate interests (and legal obligation where applicable) — it is not a separate bundled “I consent to processing” checkbox on the form. Optional processing (personalized ads, analytics, push/email) is controlled separately in Privacy & ads and, where required, under ePrivacy / PECR.
- We may refuse, suspend, or terminate accounts that violate these Terms or applicable law.
3. The service
Isegora lets you create and share polls, vote, view aggregate results (including geography and demographics), comment after a poll closes, follow creators, and optionally attach short video clips. Features may change. While a poll is open we keep a private per-poll link so you can change your vote and cannot vote twice; when the poll closes that link is destroyed, so nobody (including us) can tell how you voted. Published geographic breakdowns are also generalised so no named area represents fewer than 10 voters (smaller areas appear as Unknown).
4. Your content and illegal content
You retain ownership of content you post (polls, comments, clips, profile text/avatar). You grant Isegora a worldwide, non-exclusive license to host, display, moderate, and distribute that content as needed to operate and promote the service.
You must not post content that is illegal where you or we operate, or that exploits minors, constitutes CSAM, credible threats, targeted harassment, hate speech that is unlawful, fraud/scams, non-consensual intimate imagery, severe privacy invasions, or other categories we list in our reporting tools.
Zero tolerance. We have zero tolerance for objectionable content or abusive users.
Review. We may review content (including with automated checks and human review) to help keep the service safe and enforce these Terms.
Notice and action. Anyone can report poll, comment, or profile content in-app (mandatory category + optional comment). You can block abusive users (public profile → Block) and hide polls from your feed (poll detail → Hide from feed). We aim to act on user reports within 24 hours by removing violating content and restricting offending accounts when warranted. We may hide, remove, or restrict content or accounts. Where we restrict your content or account, we will provide a clear reason when required by law (including DSA transparency expectations). Non-consensual intimate imagery (Take It Down Act). Isegora prohibits non-consensual intimate imagery, including digitally forged or deepfake intimate imagery. Anyone — including people without an Isegora account — may submit a removal request at https://isegora.com/legal/take-it-down (also linked from Support and the in-app Report dialog). A valid request identifies the content, includes contact information, a good-faith statement, and an electronic signature. When a request is valid, we aim to remove the content within 48 hours and to make reasonable efforts to remove identical copies we can locate on Isegora. Account holders may also choose the report category Non-consensual intimate imagery (incl. deepfakes).
Preservation. Content under investigation may be retained under a legal hold even after account deletion, as described in the Privacy Policy — balancing your erasure rights with legitimate interests / legal obligations to investigate abuse and comply with DSA / Online Safety / law-enforcement duties.
We cooperate with lawful information requests from competent authorities when legally required.
5. Acceptable use
Do not: scrape or overload the service; bypass security, CAPTCHA, or network checks; use bots or anonymizing networks to abuse voting or sign-up; impersonate others; or reverse engineer except where allowed by law.
6. Ads, analytics and third parties
The app may show ads. Personalized ads, product/advertising analytics, and experimentation analytics run only with your consent where required (ePrivacy / PECR / US state opt-out expectations). Technical crash/performance monitoring may run under legitimate interests as described in the Privacy Policy. Third-party sign-in and share destinations have their own terms.
7. Communications
We may send transactional messages (e.g. verification SMS, security notices). Optional push and follow emails require your consent and can be turned off in Privacy & ads (CAN-SPAM, PECR, TCPA transactional vs marketing distinction — see Privacy Policy).
8. Deletion
You may delete your account in Privacy & ads. Deletion hides your content immediately; residual retention (including the 90-day purge window and any legal hold) is explained in the Privacy Policy and exists so we can investigate abuse and meet legal duties.
9. Disclaimers
Isegora is provided “as is.” We do not warrant uninterrupted or error-free operation, or that poll results are complete or unbiased. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits mandatory consumer rights you have in your country of residence (including in the EEA/UK).
10. Limitation of liability
To the fullest extent permitted by law, Isegora and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill. Our aggregate liability for claims relating to the service is limited to the greater of (a) amounts you paid us for the service in the 12 months before the claim, or (b) USD $50. Some jurisdictions (including parts of the EEA/UK) do not allow certain limits; there, our liability is limited to the maximum permitted, and we do not exclude liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited by law.
11. Changes and termination
We may update these Terms; the effective date will change. Continued use after notice constitutes acceptance when permitted by law. We may suspend or end the service or your access for violations, risk, or operational reasons, consistent with applicable platform-safety laws.
12. General
If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement about the service. Governing law and venue will be those of the competent courts where the Isegora operator is established, without prejudice to mandatory protections where you live (EEA/UK consumer law, and non-waivable US state rights).
